Public Use of Lands Owned or Controlled by Fish and Game (IDAPA 13.01.03)Effective: 3/31/2022

Prohibits landing, launching, or operating unmanned aircraft systems on lands owned or controlled by the Idaho Department of Fish and Game without specific authorization; requires use of designated public airstrips.

Taking of Wildlife Unlawful Except by Statute or Commission Rule (Idaho Code §36-1101)Effective: 1/1/1970

Makes it unlawful to use any aircraft, including UAS, to locate or take big game animals, birds, or furbearing animals except as provided by statute, commission rule, or proclamation.

Restrictions on Use of Unmanned Aircraft Systems (Idaho Code §21-213)Effective: 7/1/2013

Prohibits using an unmanned aircraft system to conduct surveillance, gather evidence, or photograph “specifically targeted” persons or private property without a warrant; provides a civil cause of action with statutory damages of at least $1,000 and exempts emergency response, search and rescue, and predator control.
