State Wildlife Management Area Drone Ban (ND Admin Code 30-04-02-22)Effective: 3/31/2022

Prohibits operation of any drone or radio-controlled aircraft on state wildlife management areas unless authorized by the director or the director’s designee.

Private Surveillance Prohibition (HB 1328 of 2015)Effective: 6/1/2015

Prohibits private individuals from using unmanned aircraft to conduct surveillance of persons or property without their express, informed consent, subject to exceptions for border patrol, exigent circumstances, and research.

UAS Registration ExemptionEffective: 3/1/2022

North Dakota does not require state registration of UAS except when used for agricultural aerial application, which must be licensed by the ND Aeronautics Commission.

Law Enforcement UAS Warrant Requirements (NDCC 29-29.4-03)Effective: 7/1/2013

Warrants for UAS use must satisfy constitutional requirements and include a detailed data collection statement covering authorized users, locations, flight duration, data types, retention, and destruction policies.

Law Enforcement UAS Use Limitations (NDCC 29-29.4-02)Effective: 7/1/2013

Information obtained by an unmanned aerial vehicle is not admissible in any prosecution or proceeding within the state unless obtained pursuant to a valid search warrant or recognized exception.

UAS Surveillance Documentation (NDCC 29-29.4-06)Effective: 7/1/2013

Requires documentation of all UAS surveillance flights—including duration, path, objectives—with flight information verified, retained for five years, and non-crime data destroyed within 90 days.

Prohibited UAS Uses (NDCC 29-29.4-05)Effective: 7/1/2013

Law enforcement agencies may not authorize private persons to conduct UAS surveillance or arm UAS with lethal weapons.
