Use of Drones; FAA Requirements (§4623)Effective: 10/1/2016

Any use of drones by any person or agency must comply with all applicable Federal Aviation Administration requirements and guidelines.

Operation Over Private Property (§4626)Effective: 7/1/2022

A person shall not fly a drone for hobby or recreational purposes below 100 ft AGL over private real property without prior written consent, nor record images of such property or its occupants for surveillance; first violation $50, subsequent $250.

Reports (§4624)Effective: 10/1/2016

On or before September 1 of each year, any law enforcement agency that used a drone in the previous 12 months shall report usage counts, incident types, data collected, rationales, costs, and funding sources to the Department of Public Safety, which must forward these to the Judiciary and Government Operations Committees by December 1.

Law Enforcement Use of Drones (§4622)Effective: 10/1/2016

Except as provided in §4622(c), law enforcement agencies shall not use drones or information acquired through drones to investigate, detect, or prosecute crime, nor gather or retain data on private citizens exercising free speech or assembly without obtaining a search warrant or meeting recognized exigent circumstances.

Correctional Facilities; Use Prohibited (§4625)Effective: 10/1/2016

A person shall not knowingly operate a drone over a correctional facility or its grounds recognizable as such; violations incur a civil penalty up to $500, with exemptions for certain state, law enforcement, and emergency operations.
